On a recent meeting the European Commission (EC) and Member States exchanged views on the risk management options under the Article 8 procedure of Regulation 1925/2006 for alpha lipoic acid (ALA) in fortified food, but also in food supplements.
It was confirmed that diverging positions were expressed. It seems that in favour of placing the substance in Annex III:
Part A (ban) were the EC; and the Danish, Dutch, Estonian, Slovakian, and Spanish authorities;
Parts B and C (additional warnings and scrutiny) were the German and Greek authorities;
Part B (additional warnings) were the Belgian, Italian, and Romanian authorities;
Other national authorities were still undecided.
The EC will consider the writen positions of the Member States and take a decision on this so-called ‘scrutiny’ procedure in the coming months, most probably.
We will keep you updated on furhter developments.
